These terms and conditions create a contract between you and FOCUSONE Payment Solutions (“the Agreement”). 

INTRODUCTION 

FOCUSONE Payment Solutions is a Payment Service Provider (PSP). MOCO App is a product of FOCUSONE Payment Solutions. This Agreement governs your use of MOCO and various services rendered by MOCO.

Kindly read all the terms and conditions (T&C) carefully before registering on, accessing, or using MOCO. By continuing with the Sign Up process, it will be considered that you have read, understood, accepted, and will abide by all the T&C herewith. 

DEFINITIONS

  • FOCUSONE Payment Solutions is the parent company for MOCO.
  • MOCO means Mobile Commerce. It is a digital wallet.
  • MOCO ID means the mobile number which is used for Signing Up. 
  • OTP means One Time Password. 
  • “User” refers to the person who has registered in MOCO and is using a MOCO wallet.
  • Wallet means the MOCO Wallet.
  • “App” refers to MOCO App.
  • “Merchants” means a registered business under the company act of Nepal that is selling products and services that are not prohibited by the Government of Nepal that accepts payment via MOCO Wallet.
  • “Cards” means any payment card (Visa, UPI, SCT, or other) issued by the issuing banks.
  • “MPIN” means Mobile Personal Identification Number
  •  “Transaction” means the amount spend by the MOCO User while purchasing any goods or services,
  • “Issuing Bank” means the bank that has issued Debit, Credit, or Prepaid cards of various payment associations.
  • “Rewards” means the additional bonus given by MOCO on the successful transaction.

ELIGIBILITY

Any person who is above 16 years of age can register for a MOCO wallet. The registering person needs to provide a valid government-issued document such as  Citizenship ID, Passport, or Driving license for KYC verification.

REGISTRATION

  • You may set up MOCO using the application that you can download either from the app store or google play on your mobile device. 
  • You must complete the registration process by providing your personal information such as name, number, email, address, etc., and a valid legal document before using MOCO.
  • All the information that you provide during registration should be true and as per the legal document issued by the government of Nepal. 
  • Upon successful completion of registration, your wallet will be created.  You can access this wallet using your MOCO PIN or Biometric.
  • FOCUSONE Payment Solutions will inquire to validate the card that you are trying to load into your MOCO wallet. All of the participating issuer's cards may not be eligible. If your card issuing bank does not currently support MOCO, your card will not be eligible to be added to MOCO. FOCUSONE Payment Solutions may alert you via email when your card becomes eligible. 
  • KYC verification should be done for performing transactions of above Rs. 5,000.
  • In case the information input by the user does not match with the uploaded document, the FOCUSONE Payment Solutions team is authorized to make changes to the information with reference to the uploaded document.
  • Your MOCO account will be inactive if you do not perform any transaction for up to six months and will be dormant if you do not perform any transaction for Six to twelve months.
  • Your MOCO account will be disabled if you do not perform any transaction for Eighteen months.

SECURITY

  • You will have to enter your MOCO PIN, or Card PIN or authenticate through means of biometrics to initiate payment for every transaction. 
  • Your card issuing bank shall authenticate and authorize the transaction and relay the information to FOCUSONE Payment Solutions. The same information is then transferred to the merchant electronically to complete the transaction. If we cannot charge your credit/debit card for any reason (such as but not limited to expiration or insufficient funds) the transaction will fail. 
  • However, if you collect the goods and services from our merchant you remain responsible to make settlements for any uncollected amounts. We shall attempt to contact you directly or through your bank to make the payment.
  • Few of the features such as but not limited to add card and change PIN are secured by OTP (One Time Password) sent to your registered mobile number. For this reason in case you lose your sim card it is your sole responsibility to get the sim card blocked. FOCUSONE Payment Solutions is not responsible for any harm caused due to the mishandling of your mobile phone.
  • The user agrees to keep their OTP confidential and secure. Any sharing of the OTP by the user shall be considered a breach of security and the user shall be solely responsible for any resulting security threat or loss. MOCO shall not be held liable for any damages or losses incurred due to the user's failure to keep their OTP confidential.
  • The user should be responsible for maintaining the confidentiality and security of their MOCO ID. FOCUSONE Payment Solutions is not responsible for any losses arising from the unauthorized use of your MOCO ID.
  • It is your responsibility to notify FOCUSONE Payment Solutions immediately if you suspect that your MOCO ID has been compromised.

USAGE RULE

Your use of the MOCO App must follow the rules outlined in this section (“Usage Rules”). Any other use of MOCO is a material breach of this Agreement. FOCUSONE Payment Solutions may monitor your use of the App to ensure that you are following these Usage Rules.

  • Your MOCO account is not transferable and shall be used exclusively by only you.
  • You may add only your card. Failed attempts to load cards may be monitored and your MOCO ID may be disabled for the same.
  • You can add as many personal debit/credit cards that you own in your  MOCO ID, provided that the mobile number registered in your bank account number matches your MOCO ID.
  • To use MOCO App, you need compatible hardware, software (latest version recommended and sometimes required), and Internet access.
  • It is your responsibility not to disclose MOCO PIN, Card PIN, Passwords, and any other confidential information.
  • You undertake full responsibility for any transactions made using MOCO whether or not made with your knowledge or authority.
  • FOCUSONE Payment Solutions shall not be accountable in case any mistake occurred in a transaction performed by you. 
  • You irrevocably authorize your card issuing bank to debit your respective bank account(s) with the amount incurred in any transaction through the use of MOCO.
  • You may not tamper with or circumvent any security technology included within MOCO.
  • Modifying, copying, distributing, transmitting, publishing any FOCUSONE Payment Solutions intellectual property such as logos, trademarks in an unauthorized manner is strictly prohibited and you might be subject to legal consequences.
  • Once disabled; you shall not be able to avail of any of the services rendered by MOCO.
  • Users shall make payments to the merchants through MOCO only for those products and services that the merchants are registered for.

PRIVACY

Your use of the MOCO App is subject to FOCUSONE Payment Solutions’ Privacy Policy. The T&C works in hand with the “Privacy Policy” which can be found on our website www.moco.com.np/privacy

PAYMENTS, AND REFUNDS

  • You can acquire goods and services by using MOCO for free or for a charge (surcharge), either of which is referred to as a Transaction. Each Transaction is an electronic contract between you, your card issuing bank, and the entity providing the goods and services referred to as Merchant, either on MOCO App or in-store. You acknowledge and agree that your transactions through MOCO are transactions between you and the merchant and not with FOCUSONE Payment Solutions or any of their affiliates.
  • All transactions are final. Surcharge if applicable on transactions may change at any time and shall be displayed visibly. If technical problems prevent the purchase of goods and services, your exclusive and sole remedy is using a different mode of payment.
  • FOCUSONE Payment Solutions may not be bound to carry out the operation upon your request through MOCO if it is found to be suspicious. 
  • Sending, Receiving, or transacting on MOCO for the exchange of goods and services that are prohibited, restricted, or otherwise deemed illegal according to prevailing Laws of Nepal such as gambling, betting, pornographic content, buying and selling drugs is strictly prohibited.
  • Users shall make payments to the merchants through MOCO only for those products and services that the merchants are registered for.
  • In case of a successful transaction where goods or service is not delivered FOCUSONE Payment Solutions may request the merchant to process a refund. FOCUSONE Payment Solutions may refuse a refund request if we find evidence of fraud, refund abuse, or other manipulative behavior.

TICKET BOOKING

  • MOCO is a platform where you can purchase flight tickets. The travel service is not operated by MOCO but by a partner travel operator. MOCO is responsible for facilitating payments for issuing a valid ticket and providing support in case of refund and cancellation. 

  • MOCO won't be responsible for the cases of booking cancellations done from the merchant's side. As Cancellation policy is not predefined by MOCO, it is not responsible for cancellation charges. In case your flight is late or canceled due to unavoidable reasons, the rescheduling or refund is to be settled with the travel operator directly. The contact number of the travel operator is mentioned in the issued ticket that can be viewed in the “My Ticket” section of the MOCO App.

  • While booking tickets through MOCO, it is the responsibility of the users to fill in the valid information details including nationality. Based on valid information, users will be informed in case of cancellation or Flight delayed. In case of wrong information provided by the user while booking, the user may not receive SMS or email. However, the booking is still valid. Users can contact the support team of MOCO  in case of delayed notification.

  • In case of booking tickets for a third person or multiple persons, you should provide their correct name and other details. Any changes in the flight timing or any information concerning the ticket will be passed on to you by the airlines or travel operator via email or SMS. 

  • Tickets will only be canceled or rescheduled as per the policy of the airlines. MOCO has no role in defining and determining the cancellation or rescheduling charges. Conditions of the contract will be based on the ticket of the airlines.

  • Cancellations will be done according to the actual fare of the tickets. However, in cases when the user uses any coupon code for ticket booking, the cancellations will be calculated according to the discounted value.

  • All the passengers must have a copy of tickets and also a valid identification document like citizenship or driving license or passport. In case a user is unable to present a valid identification document He/She will not be allowed to board the aircraft.

REWARD, OFFERS, AND LOYALTY PROGRAMS

  • FOCUSONE Payment Solutions does not guarantee the security of a third-party merchant's offers, rewards, loyalty program, or gift card program, and does not guarantee that the merchant's systems will be error-free, or that merchant systems will honor all offers, rewards, and loyalty points or gift cards.

  • FOCUSONE Payment Solutions shall offer reward points for the use of MOCO. These reward points can be used to redeem gifts from MOCO’s Reward List. 

SUBMISSION GUIDELINES 

Our Services may allow you to submit materials such as comments, pictures, videos, and podcasts (including associated metadata and artwork). Your use of such features must comply with the Submissions Guidelines below, which may be updated from time to time. If you see materials that do not comply with the Submissions Guidelines, please report to us. You hereby grant FOCUSONE Payment Solutions a worldwide, royalty‐free, perpetual, nonexclusive license to use the materials you submit within the Services and related marketing and FOCUSONE Payment Solutions' internal purposes. FOCUSONE Payment Solutions may monitor and decide to remove or edit any submitted material.

You may not use the Services to:

  • post any materials that you do not have permission, right, or license to use;

  • post objectionable, offensive, unlawful, deceptive, or harmful content;

  • post personal, private, or confidential information belonging to others;

  • request personal information from a minor;

  • impersonate or misrepresent your affiliation with another person or entity;

  • post or transmit spam, including but not limited to unsolicited or unauthorized advertising, promotional materials, or informational announcements;

  • plan or engage in any illegal, fraudulent, or manipulative activity. 

CONSENT TO USE OF DATA

FOCUSONE Payment Solutions may collect and use technical data and related information—including but not limited to technical information about your device, system and application software, and peripherals—that is gathered periodically to facilitate the provision of software updates, product support, and other services to you (if any) related to the App. FOCUSONE Payment Solutions may use this information, to improve its products or to provide better services or technologies to you.

RECOMMENDATION FEATURE

MOCO may recommend merchants to you based on your downloads, purchases, location, and other activities. Some recommendation features may require your permission before they are turned on. If you turn on these features, it will be considered that you provide FOCUSONE Payment Solutions permission to collect and store certain data, including but not limited to data about your activity, location, and usage. Please carefully read the information presented when you turn on these features. 

APP MAINTENANCE AND SUPPORT

FOCUSONE Payment Solutions shall be responsible for providing maintenance and support for MOCO App, or as required under applicable law.

AMENDMENT

FOCUSONE Payment Solutions reserves the right to amend this Agreement anytime as per the requirement and to add new or additional terms and conditions on your use of the services. Such modifications and additional terms and conditions will be effective immediately and incorporated into this Agreement. (after the revised agreement is posted on our website, social media pages, or any other reliable source) Your continued use of MOCO will be deemed acceptance thereof.

TERMINATION AND SUSPENSION OF SERVICES

If you fail, or FOCUSONE Payment Solutions suspects that you have failed, to comply with any of the provisions of this Agreement, FOCUSONE Payment Solutions may without notice to you:

  • terminate this Agreement and/or your MOCO ID, and you will remain liable for all amounts due under your MOCO ID up to and including the date of termination; and/or

  • preclude your access to the App.

FOCUSONE Payment Solutions can suspend your MOCO account if you have not performed any transaction for Eighteen months from your MOCO account. 

FOCUSONE Payment Solutions further reserves the right to modify, suspend, or discontinue the MOCO App (or any part or content thereof) at any time with or without notice to you, and FOCUSONE Payment Solutions will not be liable to you or to any third party should it exercise such rights.

DISCLAIMER OF WARRANTS; LIABILITY LIMITATION

FOCUSONE Payment Solutions does not guarantee, represent, or warrant that your use of the services will be uninterrupted or error‐free, and you agree that from time to time FOCUSONE Payment Solutions may remove the services for indefinite periods, cancel the services at any time, or otherwise limit or disable your access to the services without notice to you.

You expressly agree that your use of, or inability to use, the services are at your sole risk. The goods and services purchased by you through the MOCO application are (except as expressly stated by FOCUSONE Payment Solutions) provided "as is" and "as available" for your use, without warranties of any kind, either express or implied, including all implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. Because some jurisdictions do not allow the exclusion of implied warranties, the above exclusion of implied warranties may not apply to you. 

In no case shall FOCUSONE Payment Solutions, its directors, officers, employees, affiliates, agents, contractors, or licensors be liable for any direct, indirect, incidental, punitive, special, or consequential damages arising from your use of MOCO or for any other claim related in any way to your use of MOCO, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the app.

GOVERNING LAW AND DISPUTES 

This Agreement and the relationship between you and FOCUSONE Payment Solutions, and all transactions on the services shall be governed by the laws of Nepal. All disputes are subject to the jurisdiction of courts in Kathmandu, Nepal.

OTHER PROVISIONS

This Agreement constitutes the entire agreement between you and FOCUSONE Payment Solutions and governs your use of the service “MOCO”, superseding any prior agreements concerning the same subject matter between you and FOCUSONE Payment Solutions. You also may be subject to additional terms and conditions that may apply when you use affiliate services, third‐party content, third‐party software, or additional services. If any part of this Agreement is held invalid or unenforceable, that portion shall be construed in a manner consistent with applicable law to reflect, as nearly as possible, the original intentions of the parties, and the remaining portions shall remain in full force and effect. FOCUSONE Payment Solutions’ failure to enforce any right or provisions in this Agreement will not constitute a waiver of such or any other provision. FOCUSONE Payment Solutions will not be responsible for failures to fulfill any obligations due to causes beyond its control. (such as in the case of natural calamities or any other unforeseen future events). You agree to comply with all local, state, federal, and national laws, statutes, ordinances, and regulations that apply to your use of the services. Your use of the Services may also be subject to other laws. FOCUSONE Payment Solutions may notify you for the Services by sending an email message to your email address or a letter via postal mail to your mailing address, or by a posting on the Services via push notification. Notices shall become effective immediately. FOCUSONE Payment Solutions may also contact you by email or push notification to send you additional information about the Services.

You hereby grant FOCUSONE Payment Solutions the right to take steps FOCUSONE Payment Solutions believes are reasonably necessary or appropriate to enforce and/or verify compliance with any part of this Agreement. You agree that FOCUSONE Payment Solutions has the right, without liability to you, to disclose any data and/or information to law enforcement authorities, government officials, and/or a third party, as FOCUSONE Payment Solutions believes is reasonably necessary or appropriate to enforce and/or verify compliance with any part of this Agreement (including but not limited to FOCUSONE Payment Solutions' right to cooperate with any legal process relating to your use of the Services and/or Content, and/or a third‐party claim that your use of the Services and/or Content is unlawful and/or infringes such third party's rights).

यी नियम र सर्तहरूले तपाईं र FOCUSONE सँगको भुक्तानी समाधानहरू बीचको सम्झौता सिर्जना गर्दछ।

परिचय

FOCUSONE Payment Solutions एक भुक्तानी सेवा प्रदायक (PSP) हो। MOCO एप FOCUSONE FOCUSONE Payment Solutions को उत्पादन हो। यो सम्झौताले तपाइँको MOCO को प्रयोग र MOCO द्वारा प्रदान गरिएका विभिन्न सेवाहरूलाई नियन्त्रण गर्दछ।

कृपया MOCO मा दर्ता, पहुँच वा प्रयोग गर्नु अघि सबै नियम र सर्तहरू (T&C) ध्यानपूर्वक पढ्नुहोस्। साइन अप प्रक्रिया जारी गर्दा, तपाईंले पढ्नुभयो, बुझ्नुभयो, स्वीकार गर्नुभयो, र यसका सबै T&C पालना गर्नु भएको छ भनी मानिनेछ।

परिभाषाहरू

  • MOCO को लागि FOCUSONE Payment Solutions मूल कम्पनी हो।
  • MOCO को अर्थ मोबाइल कमर्स हो। यो एक डिजिटल वालेट हो।
  • MOCO ID भनेको मोबाइल नम्बर हो जुन साइन अप गर्न प्रयोग गरिन्छ।
  • OTP को One Time Password हो।
  • "प्रयोगकर्ता" भन्नाले MOCO मा दर्ता भएको र MOCO वालेट प्रयोग गरिरहेको व्यक्तिलाई जनाउँछ।
  • वालेट भनेको MOCO वालेट हो।
  • "App" ले MOCO एपलाई जनाउँछ।
  • “Merchants” भन्नाले नेपाल सरकारले निषेध नगरेका उत्पादन र सेवाहरू बिक्री गर्ने र MOCO वालेट मार्फत भुक्तानी स्वीकार गर्ने नेपालको कम्पनी ऐन अन्तर्गत दर्ता भएको व्यवसायलाई जनाउँछ।
  • "Cards" भन्नाले कार्ड जारी गर्ने बैंकहरूले जारी गरेको कुनै पनि भुक्तानी कार्ड (VISA, UPI, SCT, वा अन्य) बुझिन्छ।
  • “MPIN” को अर्थ मोबाइल व्यक्तिगत पहिचान नम्बर (Mobile Personal Identification Number) हो।
  • "Transaction" भन्नाले कुनै पनि वस्तु वा सेवाहरू खरिद गर्दा MOCO प्रयोगकर्ताले खर्च गरेको रकम हो।
  • “Issuing Bank” भन्नाले विभिन्न payment associations हरूको डेबिट, क्रेडिट वा प्रिपेड कार्डहरू जारी गरेको बैंकलाई जनाउँछ।
  • "Rewards" भनेको सफल कारोबारमा MOCO द्वारा दिइएको अतिरिक्त बोनस हो।

योग्यता

१६ वर्षभन्दा माथिका कुनै पनि व्यक्तिले MOCO वालेटको लागि दर्ता गर्न सक्छन्। दर्ता गर्ने व्यक्तिले KYC प्रमाणिकरणको लागि नागरिकता आईडी, राहदानी, वा ड्राइभिङ इजाजतपत्र जस्ता सरकारले जारी गरेको मान्य कागजातहरू उपलब्ध गराउनु पर्छ।

दर्ता

  • तपाईंले App store वा Play store बाट डाउनलोड गर्न सक्ने एप्लिकेसन प्रयोग गरी MOCO सेटअप गर्न सक्नुहुन्छ।
  • तपाईंले MOCO प्रयोग गर्नु अघि आफ्नो व्यक्तिगत जानकारी जस्तै नाम, नम्बर, इमेल, ठेगाना, आदि, र वैध कानूनी कागजात प्रदान गरेर दर्ता प्रक्रिया पूरा गर्नुपर्छ।
  • तपाईंले दर्ता गर्दा प्रदान गर्नुहुने सबै जानकारीहरू सत्य र नेपाल सरकारले जारी गरेको कानुनी कागजात अनुसार हुनुपर्छ।
  • दर्ताको सफलतापूर्वक समापन भएपछि, तपाईंको वालेट सिर्जना गरिनेछ। तपाईंले आफ्नो MOCO PIN वा बायोमेट्रिक प्रयोग गरेर यो वालेट पहुँच गर्न सक्नुहुन्छ।
  • FOCUSONE Payment Solutions बाट तपाईंले आफ्नो MOCO वालेटमा लोड गर्ने प्रयास गरिरहनुभएको कार्ड प्रमाणित गर्न सोधपुछ गर्नेछ। सबै कार्डहरू लोड गर्न योग्य नहुन सक्छन्। यदि तपाईंको डेबिट/क्रेडिट कार्ड जारी गर्ने बैंकले हाल MOCO समर्थन गर्दैन भने, तपाईंको कार्ड MOCO मा थप्न योग्य हुनेछैन। FOCUSONE Payment Solutions ले तपाईंको कार्ड योग्य भएपछि इमेल मार्फत तपाईंलाई सचेत गराउनेछ।
  • रु. ५,००० भन्दा माथिको कारोबार गर्नको लागि KYC प्रमाणिकरण गरिनु पर्छ।
  • यदि प्रयोगकर्ता द्वारा जानकारी गरिएको विवरण कागजातसँग मेल खाँदैन भने, FOCUSONE Payment Solutions टोलीलाई अपलोड गरिएको कागजातको सन्दर्भमा जानकारीमा परिवर्तनहरू गर्न अधिकार छ।
  • यदि तपाइँले ६ महिना सम्म कुनै पनि कारोबार गर्नुहुन्न भने तपाइँको MOCO खाता निष्क्रिय हुनेछ र यदि तपाइँ छ देखि बाह्र महिना सम्म कुनै कारोबार गर्नुहुन्न भने असक्षम हुनेछ।
  • यदि तपाईंले १८ महिनासम्म कुनै पनि कारोबार गर्नुभएन भने तपाईंको MOCO खाता निलम्बन गरिनेछ।

सुरक्षा

  • तपाईंले आफ्नो MOCO PIN, वा कार्ड PIN प्रविष्ट गर्नुपर्नेछ वा प्रत्येक कारोबारको लागि भुक्तानी सुरु गर्न बायोमेट्रिक्सको माध्यमबाट प्रमाणीकरण गर्नुपर्नेछ।
  • तपाईंको कार्ड जारी गर्ने बैंकले कारोबारको प्रमाणीकरण र अधिकार दिनेछ र जानकारी FOCUSONE Payment Solutions मा पठाउनेछ। सोही कारोबार पूरा गर्न इलेक्ट्रोनिक रूपमा Merchants लाई जानकारी हस्तान्तरण गरिन्छ। यदि हामीले कुनै पनि कारणले तपाईंको क्रेडिट/डेबिट कार्ड चार्ज गर्न सक्दैनौं (जस्तै म्याद समाप्ति वा अपर्याप्त रकम आदि) कारोबार असफल हुनेछ।
  • यद्यपि, यदि तपाईंले हाम्रो Merchants बाट वस्तुहरू वा सेवाहरू प्रयोग वा सङ्कलन गर्नुभयो भने, तपाईंले प्रयोग वा सङ्कलन गर्नुभएको वस्तुहरू वा सेवाहरू भुक्तानीको लागि स्वम जिम्मेवार हनुपर्दछ। भुक्तानी गर्नको लागि हामी सिधै तपाईं वा तपाईंको बैंक मार्फत तपाईंलाई सम्पर्क गर्ने प्रयास गर्नेछौं।
  • कार्ड थप्न र पिन परिवर्तन गर्न सीमित नभएका केही सुविधाहरू तपाईंको दर्ता गरिएको मोबाइल नम्बरमा पठाइएका OTP (वन टाइम पासवर्ड) द्वारा सुरक्षित छन्। कुनै कारणले गर्दा यदि तपाईंले आफ्नो सिम कार्ड हराउनुभयो भने त्यो सिम कार्ड ब्लक गराउनु तपाईं स्वमको जिम्मेवारी हुनेछ।FOCUSONE Payment Solutions तपाईंको मोबाइल फोनको गलत प्रयोगको कारणले गर्दा हुने कुनै पनि हानिको लागि जिम्मेवार हुँदैन।
  • प्रयोगकर्ता आफ्नो OTP गोप्य र सुरक्षित राख्न सहमत छन्। प्रयोगकर्ताद्वारा OTP को कुनै पनि विवरण वितरणलाई सुरक्षाको उल्लङ्घन मानिनेछ र कुनै पनि सुरक्षा खतरा वा हानिको लागि प्रयोगकर्ता स्वम जिम्मेवार हुनेछ। प्रयोगकर्ताले आफ्नो OTP गोप्य राख्न असफल भएको कारणले गर्दा भएको कुनै पनि क्षति वा नोक्सानीको लागि MOCO उत्तरदायी हुने छैन।
  • प्रयोगकर्ता आफ्नो MOCO ID को गोपनीयता र सुरक्षा कायम गर्न जिम्मेवार हुनुपर्दछ। FOCUSONE Payment Solutions तपाईंको MOCO ID को अनाधिकृत प्रयोगबाट हुने कुनै पनि हानिको लागि जिम्मेवार छैन।
  • यदि तपाईंलाई आफ्नो MOCO ID मा छेदन गरिएको छ भन्ने शंका लाग्छ भने FOCUSONE Payment Solutions लाई तुरुन्तै सूचित गर्नु तपाईंको जिम्मेवारी हो।

प्रयोग नियम

तपाईंले MOCO एपको प्रयोगले यस खण्डमा उल्लिखित नियमहरू ("प्रयोग नियमहरू") पालना गर्नुपर्छ। MOCO को अन्य कुनै पनि प्रयोग यस सम्झौताको भौतिक उल्लङ्घन हो। तपाईंले यी प्रयोग नियमहरू पछ्याउँदै हुनुहुन्छ भनी सुनिश्चित गर्नको लागि FOCUSONE Payment Solutions ले तपाईंको एपको प्रयोगको निगरानी गर्न सक्छ।

  • तपाईको MOCO खाता स्थानान्तरण गर्न मिल्ने छैन र तपाईले मात्र प्रयोग गर्नुहुनेछ।
  • तपाईंले आफ्नो कार्ड मात्र थप्न सक्नुहुन्छ। कार्डहरू लोड गर्न असफल प्रयासहरू अनुगमन गर्न सकिन्छ र तपाईंको MOCO ID लाई त्यसैका लागि असक्षम गरिएको हुन सक्छ।
  • यदि तपाइँको बैंक खाता नम्बरमा दर्ता गरिएको मोबाइल नम्बर MOCO ID सँग मेल खान्छ भने तपाइँको स्वामित्वमा रहेको व्यक्तिगत डेबिट/क्रेडिट कार्डहरू MOCO ID थप्न सक्नुहुन्छ,।
  • MOCO एप प्रयोग गर्नको लागि, तपाईंलाई मिल्दो हार्डवेयर, सफ्टवेयर (नयाँ संस्करण सिफारिस गरिएको र कहिलेकाहीं आवश्यक), र इन्टरनेट पहुँच चाहिन्छ।
  • MOCO PIN, कार्ड PIN, पासवर्डहरू, र अन्य कुनै पनि गोप्य जानकारीहरू खुलासा नगर्नु तपाईंको जिम्मेवारी हो।
  • MOCO को प्रयोग गरेर कुनै पनि कारोबार तपाईको ज्ञान वा अधिकारबाट गरिएको होस् वा नगरिएको होस् तपाईले पूर्ण जिम्मेवारी लिनुहुन्छ।
  • तपाईंले गरेको कारोबार मा कुनै गल्ती भएमा FOCUSONE Payment Solutions जवाफदेही हुने छैन।
  • तपाईले आफ्नो कार्ड जारी गर्ने बैंकलाई MOCO को प्रयोग मार्फत कुनै पनि लेनदेनमा भएको रकमलाई आफ्नो सम्बन्धित बैंक खाता डेबिट गर्नको लागि अपरिवर्तनीय रूपमा अधिकार दिनुहुन्छ।
  • तपाईंले MOCO भित्र समावेश गरिएको कुनै पनि सुरक्षा प्रविधिसँग छेडछाड गर्न सक्नुहुन्न।
  • कुनै पनि FOCUSONE Payment Solutions को बौद्धिक सम्पत्तिहरू जस्तै लोगो, ट्रेडमार्कहरू अनधिकृत रूपमा परिमार्जन, प्रतिलिपि, वितरण, प्रसारण, प्रकाशन गर्न कडा रूपमा निषेध गरिएको छ र तपाईं कानुनी परिणामहरूको अधीनमा हुनहुनेछ।
  • एक पटक निष्क्रिय भएपछि पुणः तपाईंले MOCO द्वारा प्रदान गरिएका कुनै पनि सेवाहरू प्राप्त गर्न सक्षम हुनुहुने छैन।
  • प्रयोगकर्ताहरूले MOCO मार्फत Merchants हरूलाई ती उत्पादन र सेवाहरूको लागि मात्र भुक्तानी गर्नेछन् जुन Merchants हरू मा दर्ता भएका छन्।

तपाईंको MOCO एपको प्रयोग FOCUSONE Payment Solutions को गोपनीयता नीतिको अधीनमा छ। T&C ले "गोपनीयता नीति" को साथ काम गर्दछ जुन हाम्रो वेबसाइट www.moco.com.np/privacy मा पाउन सकिन्छ

भुक्तानी र फिर्ताहरू

  • तपाईले MOCO को प्रयोग गरेर निःशुल्क वा शःशुल्क (उपशुल्क)चार्ज साथै वस्तु र सेवाहरू अंकित अंकितमा प्राप्त गर्न सक्नुहुन्छ , जसलाई कारोबार(Transaction) भनिन्छ। प्रत्येक कारोबार तपाईं, तपाईंको कार्ड जारी गर्ने बैंक, र Merchants भनेर चिनिने (वस्तुहरू र सेवाहरू प्रदान गर्ने निकाय, MOCO एप वा In-store मा भएको) निकाय बिचको विद्युतीय सम्झौता हो। तपाईं स्वीकार गर्नुहुन्छ र सहमत हुनुहुन्छ कि MOCO मार्फत तपाईंको कारोबारहरू तपाईं र व्यापारी बीचको कारोबार हो र FOCUSONE Payment Solutions वा तिनीहरूको कुनै पनि सम्बद्धित कम्पनीहरूसँग होइन।
  • सबै लेनदेनहरू अन्तिम छन्। लेनदेनमा लागू हुने अतिरिक्त शुल्क कुनै पनि समयमा परिवर्तन हुन सक्छ र परिवर्तन भएमा देखिने रूपमा प्रकाशन हुनेछ। यदि प्राविधिक समस्याको कारण सामान र सेवाहरूको खरिदलाई रोकावट भयो भने, तपाइँको एकमात्र उपाय भुक्तानीको फरक विकल्प प्रयोग गर्नु हो।
  • यदि कारोबार शंकास्पद भयो भने MOCO मार्फत तपाईंको अनुरोधमा FOCUSONE Payment Solutions ले अपरेशन गर्न बाध्यता नहुन सक्छ ।
  • नेपाल को प्रचलित कानून अनुसार निषेधित, प्रतिबन्धित, वा अन्य गैरकानूनी मानिने सामान र सेवाहरूको आदानप्रदानको लागि MOCO मा पठाउन, प्राप्त गर्न वा कारोबार गर्न (जस्तै जुवा, सट्टेबाजी, अश्लील सामग्री, लागूपदार्थको खरिद बिक्री) गर्न कडा रूपमा निषेध गरिएको छ।
  • प्रयोगकर्ताहरूले MOCO मार्फत Merchants हरूलाई ती उत्पादन र सेवाहरूको लागि मात्र भुक्तानी गर्नेछन् जुन Merchants हरुले दर्ता गरेका छन्।
  • सफल कारोबारको अवस्थामा जहाँ सामान वा सेवा डेलिभर गरिएको छैन FOCUSONE Payment Solutionsले व्यापारीलाई फिर्ती प्रक्रिया गर्न अनुरोध गर्न सक्छ। यदि हामीले धोखाधडी, फिर्ता दुरुपयोग, वा अन्य हेरफेर व्यवहारको प्रमाण फेला पार्छौं भने FOCUSONE Payment Solutions हरूले फिर्ताको अनुरोधलाई अस्वीकार गर्न सक्छ।

टिकट बुकिङ

  • MOCO एउटा प्लेटफर्म हो जहाँ तपाईं उडान टिकटहरू खरिद गर्न सक्नुहुन्छ। यात्रा सेवा MOCO द्वारा सञ्चालित छैन तर हवाई यात्रा अपरेटरको साझेदार द्वारा गरिन्छ। MOCO बाट सफल भएको मान्य टिकट जारी गर्न र रद्द भएको कारोबारको भुक्तानी रकम फिर्ता को मामला समर्थन प्रदान गर्ने जिम्मेवारी MOCO को हुन्छ।

  • MOCO ले Merchantsको पक्षबाट बुकिङ रद्द भएको मामिलाहरूको लागि जिम्मेवार हुनेछैन। रद्द गर्ने नीति MOCO द्वारा पूर्वनिर्धारित नभएको हुनाले, यो रद्द शुल्कको लागि जिम्मेवारी हुने छैन। यदि तपाईंको उडान अन्य कुनै कारणहरूले गर्दा ढिलो भयो वा रद्द भयो भने, पुन: तालिका वा फिर्ता रकम सिधै ट्राभल अपरेटरसँग मिलाउनु पर्छ। जारी गरिएको टिकटमा यात्रा अपरेटरको सम्पर्क नम्बर उल्लेख गरिएको हुन्छ जुन MOCO एपको "My Ticket" खण्डमा हेर्न सकिन्छ।

  • MOCO मार्फत टिकट बुक गर्दा, राष्ट्रियता सहित आवश्यक वैध जानकारी विवरणहरू भर्नु प्रयोगकर्ताहरूको जिम्मेवारी हो। मान्य जानकारीको आधारमा, रद्द वा उडान ढिलाइ भएको अवस्थामा प्रयोगकर्ताहरूलाई सूचित गरिनेछ। बुकिङ गर्दा प्रयोगकर्ताले गलत जानकारी दिएको खण्डमा प्रयोगकर्ताले एसएमएस वा इमेल प्राप्त गर्ने छैनन्। यद्यपि, बुकिङ अझै मान्य हुनेछ। प्रयोगकर्ताहरूले ढिलो सूचनाको खण्डमा MOCO को ग्राहक सेवा सहयोग टोलीलाई सम्पर्क गर्न सक्छन्।

  • तेस्रो व्यक्ति वा अन्य व्यक्तिहरूको लागि टिकट बुकिङको मामलामा, तपाईंले उनीहरूको सही नाम र अन्य विवरणहरू प्रदान गर्नुपर्छ। उडानको समय वा टिकट सम्बन्धी कुनै पनि जानकारीमा कुनै पनि परिवर्तन भएमा एयरलाइन्स वा ट्राभल अपरेटरले तपाईंलाई इमेल वा एसएमएस मार्फत पठाइनेछ।

  • एयरलाइन्सको नीति अनुसार मात्र टिकट रद्द वा पुन: तालिका हुनेछ। रद्द वा पुन: निर्धारणको शुल्कहरू परिभाषित र निर्धारण गर्न MOCO को कुनै भूमिका छैन। सम्झौताका सर्तहरू एयरलाइन्सको टिकटमा आधारित हुनेछन्।

  • टिकटको वास्तविक भाडा अनुसार रद्द गरिनेछ। यद्यपि, प्रयोगकर्ताले टिकट बुकिङको लागि कुनै कुपन कोड प्रयोग गर्दा, रद्दहरू छुट मूल्य अनुसार गणना गरिनेछ।

  • सबै यात्रुहरूसँग टिकटको प्रतिलिपि र नागरिकता वा ड्राइभिङ लाइसेन्स वा राहदानी जस्ता वैध पहिचान कागजातहरू हुनुपर्छ। यदि प्रयोगकर्ताले वैध पहिचान कागजात पेश गर्न असक्षम भएमा उसलाई विमानमा चढ्न अनुमति दिइने छैन।

पुरस्कार, प्रस्ताव, र वफादारी कार्यक्रम

  • FOCUSONE Payment Solutions ले तेस्रो-पक्ष Merchants को प्रस्ताव, पुरस्कार, निष्ठा(loyalty) कार्यक्रम, वा उपहार कार्ड कार्यक्रमको सुरक्षाको ग्यारेन्टी गर्दैन, र Merchants को प्रणाली त्रुटिरहित हुनेछ भन्ने ग्यारेन्टी गर्दैन, वा तेस्रो-पक्ष Merchants प्रणालीहरूले सबै प्रस्तावहरू, पुरस्कारहरू र निष्ठा अंक(loyalty points) वा उपहार कार्डहरू स्वीकार गर्नेछन् भन्न्ने ग्यारेन्टी गर्दैन।

  • FOCUSONE Payment Solutions ले MOCO को प्रयोगको लागि पुरस्कार अंकहरू प्रस्ताव गर्नेछ। यी पुरस्कार अंकहरू MOCO को पुरस्कार सूची(Reward list)बाट उपहारहरू रिडिम गर्न प्रयोग गर्न सकिन्छ ।

सबमिशन दिशानिर्देशहरू  

हाम्रा सेवाहरूले तपाईंलाई टिप्पणीहरू, चित्रहरू, भिडियोहरू, र पोडकास्टहरू (सम्बन्धित मेटाडेटा र कलाकृति सहित) जस्ता सामग्रीहरू पेश गर्न अनुमति दिन सक्छन्। तपाइँको त्यस्ता सुविधाहरूको प्रयोगले तलको सबमिशन दिशानिर्देशहरूको पालना गर्नुपर्छ, जुन समय-समयमा अद्यावधिक हुन सक्छ। यदि तपाईंले सबमिशन दिशानिर्देशहरूको पालना नगर्ने सामग्रीहरू देख्नुभयो भने, कृपया हामीलाई रिपोर्ट गर्नुहोस्। तपाईंले यसद्वारा FOCUSONE Payment Solutionsहरूलाई विश्वव्यापी, रोयल्टी-मुक्त, सदाको लागि, तपाईंले सेवाहरू र सम्बन्धित मार्केटिङ र FOCUSONE Payment Solutions हरूको आन्तरिक उद्देश्यहरू भित्र पेश गर्नुहुने सामग्रीहरू प्रयोग गर्नको लागि गैर-विशेष इजाजतपत्र प्रदान गर्नुहुन्छ। FOCUSONE Payment Solutions हरूले कुनै पनि पेश गरिएको सामग्री हटाउन वा सम्पादन गर्ने निर्णय गर्न सक्छ।

तपाईंले यी सेवाहरू प्रयोग गर्न सक्नुहुन्न:

  • कुनै पनि सामग्री अनुमति, अधिकार, वा प्रयोग गर्न इजाजतपत्र नभएको पोस्ट गर्न सक्नुहुन्न;

  • व्यक्तिगत विवरण,आपत्तिजनक, गैरकानूनी, भ्रामक, वा हानिकारक सामग्री पोस्ट गर्न सक्नुहुन्न

  • अरूसँग सम्बन्धित व्यक्तिगत, निजी, वा गोप्य जानकारी पोस्ट गर्न सक्नुहुन्न;

  • नाबालिगबाट व्यक्तिगत जानकारी अनुरोध गर्न सक्नुहुन्न;

  • अर्को व्यक्ति वा संस्थासँगको आफ्नो सम्बद्धताको प्रतिरूपण वा गलत व्याख्या गर्न सक्नुहुन्न;

  • स्प्याम पोस्ट प्रसारण गर्न सक्नुहुन्न, अनावश्यक वा अनाधिकृत विज्ञापन, प्रचार सामग्री, वा सूचनात्मक घोषणाहरू प्रचार गर्न सक्नुहुन्न;

  • कुनै पनि अवैध, धोखाधडी, वा हेरफेर गतिविधिको योजना बनाउन वा त्यस्ता गतिविधिहरुमा संलग्न हुर्न सक्नुहुन्न;

डाटा को उपयोग को लागी सहमति

FOCUSONE Payment Solutions हरूले प्राविधिक डेटा तथा अन्य सम्बन्धित जानकारीहरू सङ्कलन गर्न र प्रयोग गर्न सक्छ तथा तपाईंको उपकरण, प्रणाली र अनुप्रयोग सफ्टवेयर, र बाह्य उपकरणहरू बारे प्राविधिक जानकारी सहितका जानकारीहरु जम्मा गर्नसक्छ जुन सफ्टवेयर अद्यावधिकहरू, उत्पादन समर्थन, र अन्य सेवाहरूको प्रावधानलाई सहज बनाउन आवधिक रूपमा भेला गरिन्छ जुन एपसँग सम्बन्धित हुनछ। FOCUSONE Payment Solutions ले यी जानकारी प्रयोग गर्न सक्छ, जसले एप सुधार गर्न वा तपाईंलाई अझ राम्रो सेवा वा प्रविधिहरू प्रदान गर्न मद्दत गर्छ।

प्रचार विशेषता

MOCO ले तपाईंको डाउनलोड, खरिद,उपस्थित स्थान र अन्य गतिविधिहरूको आधारमा तपाईंलाई Merchants हरू सिफारिस गर्न सक्छ। केही सिफारिस सुविधाहरू सक्रिय हुनु अघि तपाईंको अनुमति आवश्यक हुन्छ। यदि तपाईंले यी सुविधाहरू खोल्नु भयो भने, तपाईंले FOCUSONE Payment Solutions लाई तपाईंको गतिविधि,उपस्थित स्थान, र प्रयोगको बारेमा डेटा सहित निश्चित डेटा सङ्कलन र भण्डारण गर्न अनुमति दिनुभएको मानिनेछ। तपाईंले यी सुविधाहरू सक्रिय गर्दा प्रस्तुत जानकारी ध्यानपूर्वक पढ्नुहोस्।

एप मर्मत र स्तरवृद्धि

FOCUSONE Payment Solutionsले MOCO एपको लागि मर्मत र स्तरवृद्धि प्रदान गर्न जिम्मेवार हुनेछ, जुन प्रचलित कानून अनुसारआवश्यक पर्छ।

संशोधन

FOCUSONE Payment Solutionsले आवश्यकता अनुसार जुनसुकै बेला यो सम्झौता परिमार्जन गर्ने र तपाईंले प्रयोग गर्नु भएको सेवाहरूको नयाँ वा थप सर्तहरू थप्ने अधिकार सुरक्षित राख्दछ। त्यस्ता परिमार्जनहरू र अतिरिक्त नियम र सर्तहरू तुरुन्तै प्रभावकारी गरिनेछन् र त्यस सम्झौतामा समावेश गरिनेछ। ( संशोधित सम्झौता हाम्रो वेबसाइट, सामाजिक मिडिया पृष्ठहरू, वा कुनै अन्य विश्वसनीय स्रोतमा पोस्ट गरिसकेपछि) तपाईंले MOCO को निरन्तर प्रयोगलाई स्वीकृति मानिनेछ।

सेवाहरूको समाप्ति र निलम्बन

यदि तपाईं असफल हुनुभयो भने, वा FOCUSONE Payment Solutionsले यस सम्झौतामा उल्लेखित कुनै पनि प्रावधानहरूको पालना गर्न असफल भएको शंका भयो भने, FOCUSONE Payment Solutionsले तपाईंलाई सूचना बिना :

  • यो सम्झौता अथवा तपाइँको MOCO ID खारेज गरिन्छ, र त्यस पस्चात तपाइँको MOCO ID अन्तर्गत र समाप्तिमिति सम्मको सबै भुक्तानी तथा रकमहरूको लागि उत्तरदायी स्वम हुनुहुनेछ;

  • एपमा तपाईंको पहुँचलाई रोकिनेछ।

यदि तपाईंले आफ्नो MOCO खाताबाट १८ महिनासम्म कुनै पनि कारोबार गर्नुभएको छैन भने FOCUSONE Payment Solutionsले तपाईंको MOCO खाता निलम्बन गर्न सक्छ।

FOCUSONE Payment Solutions ले MOCO एप (वा त्यसको कुनै पनि अंश वा सामग्री) लाई कुनै पनि समयमा तपाईंलाई सूचना दिएर वा बिन सूचना नै परिमार्जन गर्ने, निलम्बन गर्ने वा बन्द गर्ने अधिकार सुरक्षित राख्छ, र FOCUSONE Payment Solutionsले तपाईं वा कुनै पनि त्यस्ता अधिकारहरू प्रयोग गर्न तेस्रो पक्षसँग उत्तरदायी हुने छैन।

वारेन्टहरूको अस्वीकरण; उत्तरदायित्वको सीमा

FOCUSONE Payment Solutionsले तपाईंको सेवाको प्रयोग निर्बाध वा त्रुटिरहित हुनेछ भन्ने ग्यारेन्टी, प्रतिनिधित्व वा वारेन्टी गर्दैन, र तपाईं सहमत दिनुहुन्छ कि समय-समयमा FOCUSONE Payment Solutionsले सेवाहरू अनिश्चित अवधिका लागि हटाउन सक्छ वा कुनै पनि समयमा सेवाहरू रद्द गर्न सक्छ जस्ले तपाइँको सूचना बिना सेवाहरूमा तपाइँको पहुँचलाई सीमित वा असक्षम पार्नसक्छ।

तपाईं स्पष्ट रूपमा सहमत हुनुहुन्छ कि तपाईंको प्रयोग, वा प्रयोग गर्न असक्षमता सेवाहरू तपाईंको एकल जोखिममा छन्। तपाईले MOCO एप्लिकेसन मार्फत खरिद गर्नुभएको सामान र सेवाहरू (FOCUSONE Payment Solutions द्वारा स्पष्ट रूपमा भनिएको बाहेक) तपाइँको प्रयोगको लागि "जस्तो छ" र "जस्तो रूपमा उपलब्ध" प्रदान गरिएको छ,त्यो कुनै पनि प्रकारको वारेन्टी बिना, अभिव्यक्त वा समावेशी, सबै समावेशी सहित Merchantsको वारेन्टी, एक विशेष उद्देश्यको लागि फिटनेस, शीर्षक, र गैर-उल्लंघन। किनभने केही अधिकार क्षेत्रहरूले निहित वारेन्टीहरूको बहिष्कारलाई अनुमति दिँदैन, निहित वारेन्टीहरूको माथिको बहिष्कार तपाईंमा लागू नहुन सक्छ।

कुनै पनि अवस्थामा FOCUSONE Payment Solutions,वा त्यहाँका निर्देशकहरू, अधिकारीहरू, कर्मचारीहरू, सम्बद्धित व्यक्तिहरु, एजेन्टहरू, करार कर्मचारी, वा इजाजतपत्रदाताहरू; कुनै पनि प्रत्यक्ष, अप्रत्यक्ष, आकस्मिक, दण्डात्मक, विशेष, वा परिणामात्मक क्षतिहरूका लागि उत्तरदायी हुनेछैनन्। तपाईंको MOCO को प्रयोगसँग सम्बन्धित कुनै पनि दावी, कुनै पनि सामग्रीमा भएका त्रुटिहरू वा छुटहरू, वा एपको प्रयोगको परिणाम स्वरूप भएको कुनै पनि प्रकारको नोक्सान वा नोक्सानीहरूका लागि उत्तरदायी हुनेछैनन्।

नियामक कानून र विवादहरू

यो सम्झौता र तपाईं र FOCUSONE Payment Solutions बीचको सम्बन्ध, र सेवाहरूमा हुने सबै लेनदेनहरू नेपालको कानुनद्वारा नियन्त्रित हुनेछन्। सबै विवादहरू काठमाडौं; नेपालका अदालतहरूको क्षेत्राधिकारको अधीनमा रहेका छन्।
